These Terms and Conditions ("Terms") govern the use of services provided by Buzz'd Mobile Bar LLC ("Buzz'd," "we," "us," or "our") to you, the client ("Client," "you," or "your"). By signing a service agreement or submitting a booking request, you agree to be bound by these Terms.
1. Services
Buzz'd Mobile Bar provides mobile bartending services, including but not limited to: setup and operation of a temporary bar, bartending staff, permit filing assistance, cocktail menu consultation, and event coordination. Services are performed in accordance with Indiana law and applicable Indiana Alcohol & Tobacco Commission (ATC) regulations.
The specific services, duration, guest count, and pricing applicable to your event are set forth in your signed Service Agreement, which is incorporated into these Terms by reference.
2. Booking and Deposit
A booking is confirmed only upon receipt of a signed Service Agreement and a non-refundable deposit equal to 25% of the total event fee. Dates are held on a first-come, first-served basis. Submission of a contact form or quote request does not constitute a confirmed booking.
The remaining balance is due no later than 7 days before the event date. Failure to remit the remaining balance by this date may result in cancellation of the booking at Buzz'd's discretion, with the deposit forfeited.
3. ATC Permit and Compliance
Buzz'd will file all required Indiana ATC temporary beer and wine permits on the Client's behalf, subject to the following conditions:
- The Client must provide complete and accurate venue information, including venue name, address, and on-site contact, at least 15 calendar days before the event date.
- Indiana ATC requires temporary permit applications to be submitted at least 5 full business days before the event. Buzz'd will file within that window provided Client information is received on time.
- If Client fails to provide required information by the 15-day deadline, Buzz'd cannot guarantee permit approval and assumes no liability for the resulting inability to serve alcohol at the event. No refund shall be issued in such circumstances.
- Permit fees ($50/day per ATC regulation) are included in all package prices. A rush filing fee of $75 applies to bookings made within 14 calendar days of the event.
- Buzz'd will coordinate with local law enforcement and the Indiana State Excise Police (ISEP) as required by law. Client agrees to cooperate with any reasonable requests from Buzz'd to facilitate this process, including written authorization for permit-related communications.
4. Alcohol Service and Responsible Service
Buzz'd's bartenders are trained in responsible alcohol service and hold valid Indiana ATC employee/server permits. Buzz'd reserves the right to refuse service to any individual who appears visibly intoxicated, regardless of the event host's preference.
Client acknowledges that Indiana law (IC 7.1-5-7-7) prohibits the furnishing of alcoholic beverages to intoxicated persons, and that Buzz'd's refusal of service to such individuals is both legally required and non-negotiable. Client agrees to hold Buzz'd harmless for any consequences arising from a lawful refusal of service.
Buzz'd does not permit alcohol service to anyone under the age of 21. Valid identification will be requested for any guest who appears to be under 30 years of age. Client is responsible for communicating this policy to their guests in advance.
5. Client Responsibilities
Client agrees to:
- Provide a safe, accessible setup area for the bar (flat surface, electricity access or advance notice of generator need).
- Designate a sober on-site contact person who can be reached throughout the event.
- Notify Buzz'd of any venue-specific policies or restrictions at least 10 days before the event.
- Provide accurate guest count estimates. Significant underestimates may result in service interruptions if product supply is insufficient.
- Ensure the event venue has any required venue-side permits or approvals separate from the ATC temporary permit.
- Complete and return the Client Onboarding Questionnaire at least 15 days before the event.
6. Cancellation and Refund Policy
All cancellation requests must be submitted in writing via email to hello@buzzdmobilebar.com. Cancellations are subject to the following schedule:
- More than 30 days before event: Deposit is forfeited. Any additional amounts paid are refunded in full.
- 15–30 days before event: Deposit is forfeited. 50% of the remaining balance paid is refunded.
- Fewer than 15 days before event: No refund. Full amount is forfeited, including any amounts paid beyond the deposit.
In the event Buzz'd must cancel due to circumstances within our control (e.g., staffing failure, equipment failure, and no suitable replacement arranged), Client will receive a full refund of all amounts paid. Buzz'd will make reasonable efforts to find a replacement solution before canceling.
Cancellations due to acts of God, government orders, venue closure, or other force majeure events will be handled on a case-by-case basis, and Buzz'd will work in good faith to reschedule or issue a partial credit.
7. Insurance
Buzz'd carries liquor liability insurance at a minimum of $500,000 per occurrence, as required by Indiana Code 7.1-3-1-6.4. Buzz'd also maintains general liability insurance. Upon request, Buzz'd will provide a Certificate of Insurance (COI) naming the venue and/or Client as additional insured. COI requests should be submitted at least 10 days before the event.
Buzz'd's insurance covers liability arising from Buzz'd's bartending services. It does not cover damage caused by guests, Client's own negligence, or events outside the scope of Buzz'd's service agreement.
8. Limitation of Liability
To the maximum extent permitted by Indiana law, Buzz'd's total liability for any claim arising out of or related to the services shall not exceed the total fees paid by Client for the event in question. Buzz'd shall not be liable for indirect, incidental, consequential, or punitive damages.
Buzz'd is not responsible for delays or service interruptions caused by late venue access, lack of electricity, acts of God, or other circumstances beyond our reasonable control.
9. Indemnification
Client agrees to indemnify and hold harmless Buzz'd Mobile Bar LLC, its members, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to: (a) Client's breach of these Terms; (b) the conduct of Client's guests; (c) Client's misrepresentation of venue information or event details; or (d) Client's failure to obtain any required venue-side permits or approvals.
10. Photography and Marketing
Buzz'd may take photographs or video at events for use in marketing materials, social media, and our website. If you prefer that your event not be photographed, please notify us in writing at least 7 days before your event and we will honor that request. Guests who appear in event photos taken by Buzz'd are deemed to have consented by their presence at a hosted event.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Indiana. Any dispute arising out of or related to these Terms shall be resolved first through good-faith negotiation, then through binding arbitration in Marion County, Indiana, under the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney's fees.
12. Amendments
Buzz'd reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. For existing bookings, the Terms in effect at the time of your signed Service Agreement govern your event.
